Adopting Group Notice Policy

Group Notice

Purpose

The purpose of this Group Notice Policy is to establish clear guidelines for how notices will be effectively communicated to parties, ensuring timely and accurate delivery of all necessary information. This policy mandates that at least one channel used for notice distribution must be EncryptedByDefault, promoting confidentiality and integrity in our communications.

Notice Scope

This policy applies to all members of WikiWe, including management, employees, any affiliated parties responsible for disseminating or receiving official notices, and now explicitly requires each member to publish their primary or notice addresses and availability schedule on their WikiWe™ Profile Builder to facilitate timely and secure communication.

Effective Notice

A notice is considered effective and duly given when dispatched to any Address specified in the document, footer, or person’s profile, subject to the following exceptions:

  • No Paper Notice: If an Address is marked with NoPaperNotice, this indicates that the party does not accept notices through physical mailing. In such cases, notices must be sent through alternative Primary Address(es) that are not subject to this restriction.
  • No Digital Notice: If an Address is marked with NoDigitalNotice, this indicates that the party does not accept notices through email or other electronic forms of communication. In such instances, notices must be sent through alternative Primary Address(es) that are not subject to this designation.
  • No Decrypted Notice: If an Address is marked with NoDecryptedNotice, this indicates that the party does not accept unencrypted or decrypted notices through electronic communication. In such instances, notices must be sent through Primary Address(es) via EncryptedByDefault Platforms.
  • Subaddress Notice: If an Address is marked with SubaddressNotice-legal, this indicates that the party does not accept notices sent to their root.address@proton.me, but only some subaddress they indicate for some purpose like root.address+legal@proton.me.
Encrypted Notice

Any party may utilize an EncryptedByDefault channel to safeguard sensitive information exchange and effective notice. An EncryptedByDefault channel is defined as any communication platform or service that provides end-to-end (E2E) encryption as the simple default for new users, ensuring that only the sender and the intended recipients can access the content of the messages during regular use. This policy is effective immediately. All group members are required to familiarize themselves with the encrypted channels available and must ensure they have access to and are capable of using these channels for official notices.

By adhering to this policy, we aim to enhance the security and reliability of our communication processes, protecting both our information and our group members.

Confidentiality

Any misunderstandings, issue, or disputes related to encryption, terminology, ontology, copyrights, publishing rights, confidentiality, and disclosures shall be interpreted under and subject to binding arbitration appointed according to the WY IDR 24-03.

Designated Notice Addresses

Notices under this policy shall be sent to the designated Primary Address(es) as specified in =this.notice-address. A Primary Address must include an end2end encryption channel address like Signal and may include physical mailing addresses, email addresses, or other forms of electronic communication platforms approved by the parties.

Disclosures

All encrypted declarations, requests, and disclosures related to =this.owner-group’s published or referenced work must be privately shared via Share.Note.sx, a similarly accessible and encrypted-by-default publishing channel, or as later specified via encrypted disclosures. Any Party may request from to another Party a encrypted and confidential and financial audit, declaration of facts, proposed remedy, and/or declaration of controlling principles, which may be neutrally witnessed or notarized.

Arbitration

Any misunderstandings, issue, or disputes related to encryption, terminology, iconography, ontology, copyrights, publishing rights, confidentiality, and disclosures shall be interpreted under and subject to binding arbitration appointed according to the WY IDR 24-03. If a Party is not satisfied with the outcome of binding arbitration, they have 30 days to file an arbitration review with a panel of 3 neutral, competent, diverse, and willing arbitrators or court venues. The vetted panel will have 30 days to reply to to the panels determination before awards are finally granted. One or more Parties may share this Extended Arbitration expense, but the cost will be born by the vetting and petitioning parties.
