Property Watching Agreement

This Agreement is made and entered into this 12th day of December, 2023, by and between:

Justin Benson, hereinafter referred to as the “Property Trustee” and Eldon Pierce, hereinafter referred to as the “Property Watcher”.

Recitals

WHEREAS, the Property Trustee is the legal trustee of the property located at 134 S Main St, La Verkin, and

WHEREAS, the Property Watcher has agreed to watch over the said property.

NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained, the parties hereto agree as follows:

  1. Grant of Authority: The Property Trustee hereby entrusts the Property Watcher with the keys to the property located at 134 S Main St, La Verkin. The Property Watcher is authorized to inspect the property at any time to ensure its safety and maintenance.

  2. Trespass Authority: The Property Watcher is authorized to legally trespass any unauthorized persons who enter the property without written permission from either the Property Trustee or the Property Watcher.

  3. Reporting Obligations: The Property Watcher is responsible for reporting any issues related to the property’s security, maintenance, or any other significant concerns to the Property Trustee in a timely manner.

  4. Waiver of Liabilities: The Property Watcher is waived from any liabilities or damages incurred in the course of performing duties under this Agreement.

  5. Termination: This Agreement shall automatically terminate upon the return of the keys to the Property Trustee by the Property Watcher, or as agreed by both parties in writing.

  6. Verification of Authenticity: The authenticity of this document may be verified by any third party by contacting either the Property Trustee or the Property Watcher.

  7. Text Message Consent: Consent to this Agreement by both parties shall be validly given via text message, with each party declaring “I accept this Property Watching Agreement dated Dec 12, 2023.”

  8. No Transfer of Property Rights: This Agreement does not constitute a transfer of any ownership rights in the property from the Property Trustee to the Property Watcher.

  9. Governing Law: This Agreement shall be governed by the laws of the state of Utah.

  10. Primary Dispute Resolution (PDR): Any disputes arising under this Agreement shall be subject to a Primary Dispute Resolution process, as agreed upon separately and in writing by the parties.

IN WITNESS WHEREOF, the parties hereto have executed this Agreement as of the date first above written.
